Plain English

Beardstown's Ch. 5 Art. VIII § 5-85 requires every landlord who owns rental property in the city to file a registration statement with the city clerk, covering both occupied and vacant units. The statement must include detailed contact information for the landlord (and, if applicable, all partners, officers, or a corporate registered agent), the property's address, unit count, construction date, and maximum occupancy figures. Additionally, each landlord must designate a local agent — a natural person aged 21 or older with an office in Cass County or a residence within 35 miles of Beardstown — who is authorized to receive code-violation notices and legal process on the landlord's behalf.

For Property Managers

Under Beardstown Ch. 5 Art. VIII § 5-85, compliant rental property operators file a registration statement with the city clerk for every property containing a rental unit, regardless of occupancy status. The statement includes full contact details for all relevant parties — partners, officers, or a corporate registered agent as applicable — along with property specifics such as unit count, build date, and maximum occupancy; note that a post office box does not satisfy the address requirement. Operators also designate a qualifying local agent (a natural person, 21 or older, with a Cass County office or a residence within 35 miles of Beardstown) who is formally authorized to accept code-violation notices and court or administrative process on the landlord's behalf.

For Tenants

Beardstown Ch. 5 Art. VIII § 5-85 establishes a public registration system that gives tenants a way to identify who owns and manages their rental property, including a local agent authorized to receive legal notices. If a landlord has not filed the required registration statement or has failed to designate a qualifying local agent, that non-compliance may be relevant in code-enforcement or administrative proceedings. Tenants who believe their landlord is not in compliance with § 5-85 can contact the city clerk's office or a local tenant-rights organization to understand what options may be available to them.
