Operative Text

Beardstown — Ch. 5 Art. VIII Rental Housing Inspection § 5-96
(a) Any appeal shall be filed within fifteen (15) days of the inspector's decision. The appeal shall be in writing. The board shall hold a hearing within forty-five (45) days of the appeal. The appellant shall have the right to notice of the hearing; to appear and be represented by counsel before the board. The appeal process, however, does not limit the city's right to file an ordinance violation.
(b) Within thirty (30) days of concluding the hearing, the board shall provide a written statement as to its findings. All decisions require a simple majority vote of the members present. A copy of each decision shall be filed with the city clerk. A copy shall be mailed, by regular mail, to the appellant at the address shown on the registration.
(c) The appellant may appeal the decision of the board to the city council. The appellant must file such a request within fifteen (15) days of the mailing of the decision with the city manager's office. The decision of the board is final if no appeal is timely filed.

Plain English

Beardstown Ch. 5 Art. VIII § 5-96 establishes a multi-step appeals process for rental housing inspection decisions. A written appeal must be filed within 15 days of an inspector's ruling, after which a hearing board convenes within 45 days, issues written findings within 30 days, and the appellant may escalate further to the city council within another 15-day window. Pursuing an appeal does not prevent the city from simultaneously pursuing an ordinance violation through its own channels.

For Property Managers

Under Beardstown Ch. 5 Art. VIII § 5-96, property owners who wish to contest an inspector's decision must act quickly, as the 15-day filing window for a written appeal is strict. Compliant operators typically track all inspection decisions carefully, maintain accurate registration addresses so that board correspondence reaches them promptly, and monitor each deadline in the multi-stage process — including the secondary 15-day window to escalate to the city council if needed. Keeping records of all filings and communications with the board and city manager's office is a standard practice throughout this process.

For Tenants

Beardstown Ch. 5 Art. VIII § 5-96 governs how inspection decisions can be challenged, and tenants should be aware that this process can affect the status of a rental property they occupy. If an inspector's decision is appealed by a landlord, tenants may wish to monitor the outcome, since the board's written findings are filed with the city clerk and are part of the public record. Tenant-rights organizations familiar with Beardstown's rental housing ordinance can help residents understand how an ongoing appeal or a parallel ordinance violation proceeding might relate to their housing situation.
