Elgin — Ch. 16.46 Residential Condominium Conversions § 16.46.060
Conversion notice requirements
Operative Text
A. Not less than one hundred twenty (120) days prior to recording the declaration submitting a property to the provisions of the Illinois Condominium Property Act (765 ILCS 605/1 et seq.), as amended, a developer shall give notice of said intent to record to all persons who are tenants of the property on the date notice is given. B. Any person who was a tenant upon the date of receiving a notice of intent to record a declaration of condominium and whose tenancy expires other than for cause prior to one hundred twenty (120) days thereafter shall have the right to extend such persons tenancy on the same terms and conditions and for the same rental cost until the one hundred twenty (120) day period expires. C. No rental lease shall be executed between an owner or owners agent and a prospective new tenant in a property for which notice of intent to record a declaration of condominium has been given to existing tenants unless the prospective new tenant initially is notified in writing of the intended recordation. No lease shall be executed so as to stipulate an expiration date prior to one hundred twenty (120) days from the date the lease becomes effective.
Elgin Ch. 16.46 § 16.46.060 establishes a mandatory notice and tenancy-protection framework when a residential property is being converted to condominiums. At least 120 days before the condominium declaration is recorded, the developer must notify all current tenants of the intended conversion. Any tenant whose lease would otherwise expire during that 120-day window has the right to remain on the same terms and rent until the period ends, and any new tenant signed during the conversion process must be informed in writing of the planned recordation before signing a lease that cannot expire sooner than 120 days after it takes effect.
Plain English — not legal advice.
Operators and developers subject to Elgin Ch. 16.46 § 16.46.060 generally deliver written notice of intent to record a condominium declaration to every tenant in occupancy at least 120 days before the recording date. Compliant operators also honor any existing tenant's right to extend their tenancy through the full 120-day period at unchanged terms and rent if the lease would otherwise expire during that window. When executing new leases during the conversion process, compliant operators provide prospective tenants with written disclosure of the intended recordation and ensure the lease term runs at least 120 days from its effective date.

Under Elgin Ch. 16.46 § 16.46.060, tenants in a property undergoing condominium conversion are entitled to at least 120 days' advance written notice before the declaration is recorded. If a tenant's lease is set to expire within that 120-day period for reasons other than cause, the tenant holds a statutory right to remain in the unit under the same rental terms until the full 120 days have elapsed. Tenants who believe these notice or extension rights have not been honored may wish to contact the City of Elgin's relevant housing or code enforcement office, review the provision directly, or reach out to a local tenant-rights organization for general guidance.
