Plain English

Elgin's Ch. 16.46 Residential Condominium Conversions § 16.46.080 establishes that any violation of the chapter's requirements constitutes a punishable offense, with fines ranging from $100 to $5,000. Crucially, each day a violation continues counts as a separate offense, meaning fines can accumulate over time. Beyond fines, the city retains the authority to suspend or revoke permits, and affected parties—including prospective buyers and current owners—may seek to rescind a sale or pursue damages if a conversion was not conducted in substantial conformance with the chapter.

For Property Managers

Operators managing residential condominium conversions in Elgin should be aware that § 16.46.080 imposes daily fines between $100 and $5,000 for each day of noncompliance with Chapter 16.46's requirements. A compliant operator generally ensures that all conversion-related obligations are met before and throughout the sales process, since each day a violation persists is treated as a distinct offense. Payment of any fine does not shield a permit from suspension or revocation, so maintaining ongoing compliance is a standard practice for operators in this space.

For Tenants

Under Elgin Ch. 16.46 § 16.46.080, prospective purchasers, purchasers, and condominium unit owners are explicitly granted the right to seek compliance with the chapter's requirements, rescind a sale that did not substantially conform to the chapter, or pursue damages. These remedies exist alongside—not instead of—any other legal or equitable rights available under law. Individuals who believe a condominium conversion did not meet the chapter's standards may wish to consult a tenant-rights organization or housing attorney to understand which of these remedies may be relevant to their circumstances.
