(B) The Director may refuse to issue any permit(s) required by the City Code for any construction, alteration, installation, razing or other work done in or on any building as defined in this Chapter, or any certificate of occupancy required by the City Code for such a building, unless the owner(s) or other applicant for such permit(s) or certificate(s) presents a current certificate of registration for the building. (C) The City Clerk shall issue no real estate transfer tax stamps for a transfer involving a building, as defined in this Chapter, unless the grantor or seller presents a current certificate of registration for the building.
Under Evanston, Ill., City Code § 5 § 5-8-6, the City's Director and Department are authorized to enforce the rental housing chapter through any lawful means, including Circuit Court proceedings or the City's administrative hearing process. Buildings covered by the chapter must carry a current certificate of registration before the City will issue construction or occupancy permits. Similarly, real estate transfer tax stamps for covered buildings cannot be issued unless the seller or grantor presents a valid registration certificate at the time of transfer.
Plain English — not legal advice.
Evanston, Ill., City Code § 5 § 5-8-6 creates practical checkpoints that compliant property owners generally clear before undertaking construction work, seeking a certificate of occupancy, or selling a covered building. Operators who maintain a current certificate of registration avoid permit denials and delays at the City's permitting counter. Keeping registration current also ensures that real estate transfer tax stamps can be issued without interruption when a sale is being processed.

Evanston, Ill., City Code § 5 § 5-8-6 gives tenants context for understanding how the City backs up its rental housing rules — through administrative hearings, court proceedings, and permit-related leverage over building owners. If a landlord is operating without a current certificate of registration, that non-compliance can surface during permit applications or property sales, giving the City a mechanism to act. Tenants who believe their building may be out of compliance can contact the City's Department, consult a tenant-rights organization, or look into whether a complaint through the City's administrative hearing process is available.
