Glenwood — Ch. 26 Art. XI Landlords § 26-813
Violations of this article are subject to prosecution under the village's administrative adjudication proceedings as now or herein after amended. The provisions of this article shall not preclude the village from using other methods or proceedings to adjudicate alleged violations including, without limitation, the institution of an action in the county circuit court, or before any other tribunal having jurisdiction to consider the violation. The village may also institute an action to enjoin any person form committing violations of this article. In the event an action seeking to enjoin the violation of this article is instituted by the village and an injunction issued, the person whose conduct is enjoined shall be required to pay the village for the attorneys' fees and all other costs incurred in obtaining the injunction.

Plain English

Glenwood Ch. 26 Art. XI § 26-813 establishes that violations of the landlord regulations article can be pursued through multiple legal channels, including the village's own administrative adjudication process, county circuit court, or any other tribunal with appropriate jurisdiction. The village is not limited to a single enforcement method and may choose whichever proceeding is appropriate for a given alleged violation. Additionally, the village has the authority to seek a court injunction to stop ongoing violations, and if such an injunction is granted, the person whose conduct is enjoined must reimburse the village for its attorneys' fees and all related costs.

For Property Managers

Property owners and managers subject to Glenwood Ch. 26 Art. XI § 26-813 should be aware that the village holds broad enforcement authority, meaning a violation of the article's landlord provisions can be addressed through administrative proceedings, circuit court litigation, or other tribunals. Compliant operators generally maintain practices that keep them well within the article's requirements, reducing exposure to any of these enforcement tracks. Of particular note, if the village obtains a court injunction against a landlord's conduct, that landlord becomes responsible for paying the village's attorneys' fees and all costs associated with securing that injunction.

For Tenants

Glenwood Ch. 26 Art. XI § 26-813 signals that the village itself takes an active role in enforcing the landlord regulations article, with the ability to pursue violations through administrative adjudication, circuit court, or other legal proceedings. Tenants who believe a landlord is violating the article's provisions may find it useful to report concerns to the village, which can independently initiate enforcement action including seeking an injunction. Tenant-rights organizations or legal aid services can help residents understand how the village's enforcement mechanisms under § 26-813 may interact with any rights or remedies available to them.
