Hillside — Ch. 18 Art. XV Systematic Inspection of Rental Housing § 18-639
The owner or person in charge of a rental dwelling shall correct violations of any applicable law within the time allowed by the code official. If the violations do not pose an immediate threat to life safety, the owner or person in charge of the rental dwelling will then be permitted to allow the interim occupancy of the rental dwelling during the time specified for corrective action. If the owner or person in charge of the rental dwelling fails to bring the rental dwelling into compliance within the applicable time period, the code official shall be authorized to order the vacation of the rental dwelling and to seek the revocation or suspension of any previously issued certificate of compliance still in effect. When the code official finds violations that threaten the life safety of the occupants of the rental dwelling or the occupants of nearby dwellings, the code official may order the immediate evacuation of the rental dwelling in accordance with applicable law. The code official's decision shall be subject to the proceedings set forth in Chapter 2 , Article VI of the Village Code.

Plain English

Under Hillside Ch. 18, Art. XV, § 18-639, rental property owners or managers are required to fix code violations within a deadline set by the code official. If the violations are not an immediate life-safety threat, tenants may continue living in the unit while repairs are underway. However, if corrections are not completed on time, the code official has authority to order the property vacated and to pursue revocation or suspension of any active certificate of compliance; when violations pose an immediate life-safety threat, the code official may order evacuation right away. Any decision by the code official is subject to review through the proceedings outlined in Chapter 2, Article VI of the Village Code.

For Property Managers

Under § 18-639, compliant operators track the correction deadlines assigned by the code official and complete all required repairs within those timeframes. When violations do not pose an immediate life-safety risk, tenants may remain in occupancy during the repair period, but operators should document progress to demonstrate timely compliance. Failure to meet the deadline exposes the property to a vacation order and potential revocation or suspension of its certificate of compliance, so operators generally maintain clear records of all corrective actions taken and communicate proactively with the code official.

For Tenants

Section 18-639 provides that tenants generally have the right to remain in their unit while non-life-threatening violations are being corrected within the code official's specified timeframe. If violations threaten life safety, the code official has authority to order an immediate evacuation, which is a protective measure under the provision. Tenants who believe a landlord is not correcting violations on time may contact Hillside's code official to inquire about the status of any open violations, and any official decision under this section can be challenged through the review process established in Chapter 2, Article VI of the Village Code; a local tenant-rights organization can help explain available options.
