McCook — Ch. 18 Art. XIV Rental Housing § 18-414
Penalties and administration
Operative Text
(a) Any landlord that collects rental income from a tenant of a dwelling unit without a landlord license shall be fined in an amount equivalent to the rental income collected. Each time rental income is collected shall constitute a new and separate violation. (b) Any person found in violation of any other provision of this article shall be fined no less than $100.00 nor more than $750.00. Each day a violation occurs or is permitted to continue shall constitute a new and separate violation. Violations of this article that concern multiple dwelling units shall constitute separate offenses as to those dwelling units and shall not be considered a single violation simply because the dwelling units are located in the same building or subject to the same landlord license. (c) Violations of this article may be administered through the provisions of section 1-12 of the McCook Code. Nothing in this article shall be interpreted to limit the remedies or penalties available to the village.
McCook Ch. 18 Art. XIV § 18-414 establishes a two-track penalty system for rental housing violations. A landlord who collects rent without a valid landlord license faces a fine equal to the full amount of rent collected, with each collection event treated as a separate offense. All other violations of Article XIV carry fines between $100 and $750, and each day a violation continues—or each affected dwelling unit—counts as its own distinct offense.
Plain English — not legal advice.
Under § 18-414, compliant operators in McCook maintain a current landlord license before collecting any rent, since operating without one exposes the owner to fines matching every dollar of rent received. For other Article XIV requirements, operators generally address any deficiencies promptly, because each day of non-compliance and each affected unit can generate an independent fine of up to $750. Keeping license renewals current and resolving code issues quickly are the practices that reduce exposure under this provision.

Section 18-414 gives tenants context for understanding the consequences a landlord faces for operating without a license or violating other Article XIV requirements. If a tenant believes their landlord is unlicensed or otherwise out of compliance, they may report the concern to the Village of McCook under the enforcement mechanism referenced in § 1-12 of the McCook Code. Tenant-rights organizations familiar with McCook's rental housing rules can help residents understand what documentation to gather and what options are generally available.
