Plain English

Section 16.44.120 of Mundelein's Rental Housing Properties code establishes a conflict-of-interest firewall around the officials and employees who enforce, interpret, or apply the chapter. Under this provision, those individuals are barred from having financial or professional ties to construction labor, materials, appliances, or document preparation for buildings they oversee—unless they personally own the building in question. More broadly, any work that would conflict with their official duties or with the village's interests under Illinois statute or common law is also prohibited.

For Property Managers

Property owners and managers operating under Ch. 16.44 can take note that § 16.44.120 is designed to keep enforcement personnel impartial and free from outside financial interests in the buildings they inspect or regulate. A compliant operator generally keeps records of all interactions with code-enforcement staff and, if they ever suspect an inspector has a personal financial stake in a required repair or material purchase, raises that concern through the village's official channels. Understanding this provision helps landlords recognize that enforcement decisions are expected to be made without conflicts of interest on the part of village personnel.

For Tenants

Section 16.44.120 gives tenants a basis for questioning whether an enforcement action—or a failure to enforce—was influenced by a conflict of interest on the part of a village official or employee. Tenants who believe an inspector or code-enforcement employee had an improper financial or professional connection to work performed on their building may raise that concern by filing a complaint with the Village of Mundelein or by contacting a local tenant-rights organization for guidance on available options. Consulting with a housing attorney or legal aid organization can help clarify what remedies or procedural paths may be available under this provision.
