Mundelein — Ch. 16.44 Rental Housing Properties § 16.44.170
Violation—Penalty
Operative Text
(a) A violation of this chapter shall subject the violator to a fine as set forth in general fees and penalties in the Fee Schedule Chapter 380 per violation. Each day a violation of this chapter occurs or continues shall be considered a separate and distinct violation of this chapter. (b) In addition to fines provided in this section, the village may seek any other lawful and appropriate remedy to enforce compliance with the provisions of this chapter including, but not limited to, an action in a court of competent jurisdiction for mandatory injunction, temporary restraining order, preliminary injunction, equitable relief, demolition or other lawful relief including, but not limited to, fines and costs of enforcement. The remedies available to the village shall be cumulative and not exclusive of another. The violator shall pay all reasonable attorneys' fees and costs incurred by the village in enforcing the terms of this chapter.
Section 16.44.170 of Mundelein's Rental Housing Properties chapter establishes that any violation of Chapter 16.44 carries a fine set by the village's Fee Schedule (Chapter 380), with each day a violation persists counting as a separate offense. Beyond fines, the village is authorized to pursue a broad range of legal remedies—including injunctions, equitable relief, and demolition orders—through the courts. Anyone found in violation is also responsible for covering the village's reasonable attorneys' fees and enforcement costs.
Plain English — not legal advice.
Operators of rental housing in Mundelein should be aware that under § 16.44.170, non-compliance with Chapter 16.44 can accumulate quickly, since each calendar day of an ongoing violation is treated as a distinct infraction subject to its own fine under the Fee Schedule (Chapter 380). The village retains the right to pursue court-ordered remedies—such as injunctions or even demolition—on top of those daily fines, and violators bear the village's legal costs. Compliant operators generally address any identified deficiencies promptly and maintain documentation showing corrective action was taken.
