Normal Division 25.19, Section 25.19-5 establishes a mutual framework governing landlord access to occupied rental units. Tenants are required to provide consent for entry in a defined set of circumstances—such as showings, inspections, repairs, and improvements—and may not withhold that consent unreasonably. At the same time, landlords must give at least 12 hours' advance notice, limit entry to weekday hours of 9:00 a.m.–8:00 p.m. or weekend hours of 11:00 a.m.–8:00 p.m., and knock and allow a reasonable opportunity to answer before entering.

For Property Managers

Under § 25.19-5, compliant property owners and managers document the notice they deliver to tenants at least 12 hours before any planned entry, whether for showings, inspections, repairs, or improvements. They schedule all entries within the permitted time windows—9:00 a.m. to 8:00 p.m. on weekdays and 11:00 a.m. to 8:00 p.m. on weekends—and always knock and wait for a reasonable opportunity for the tenant to respond before entering. Maintaining written records of notices and entry logs is a common practice among operators seeking to demonstrate compliance with this provision.

For Tenants

Section 25.19-5 gives tenants the right to expect at least 12 hours' advance notice before a landlord enters, entry only during the specified daytime hours, and a knock with a reasonable opportunity to answer. Tenants retain the right to withhold consent when a landlord's purpose falls outside the permitted reasons or when proper notice has not been given. Tenants who believe their rights under § 25.19-5 have been violated may consider documenting the incident in writing, raising the violation in any relevant housing proceeding, or reaching out to a local tenant-rights organization for general guidance.
