Plain English

Section 12-2-12 of North Chicago's Condominium Conversion ordinance establishes that violations of Chapter 12-2 can be addressed through court-ordered injunctions sought by the City Attorney, as well as monetary penalties. The penalty amount is set by cross-reference to Section 1-4-1 of the North Chicago City Code and applies on a per-unit basis. Critically, each day that an unlawful advertisement or offer remains active and unretracted counts as a distinct, separate offense, meaning penalties can accumulate over time.

For Property Managers

Operators involved in condominium conversions in North Chicago should be aware that Section 12-2-12 creates compounding exposure: penalties under Section 1-4-1 apply to each unit affected, and every day an improper advertisement or offer stays up without being withdrawn triggers an additional offense. Compliant operators generally ensure that all marketing materials and offers conform to Chapter 12-2 requirements before publication and promptly retract any advertisement found to be non-compliant. Because the City Attorney also has authority to seek injunctive relief in court, violations can result in both financial penalties and court-ordered cessation of activity.

For Tenants

Section 12-2-12 gives tenants in buildings undergoing condominium conversion the assurance that the City Attorney can go to court to stop violations of Chapter 12-2, and that landlords face escalating penalties for each unit and each day an improper offer or advertisement remains active. Tenants who believe a conversion-related advertisement or offer violates Chapter 12-2 can report the concern to the City Attorney's office or a local tenant-rights organization for guidance. Understanding that penalties accumulate daily per unit under Section 12-2-12 may be relevant context when exploring available enforcement paths.
