Stickney — Ch. 19 Condominium Conversions § 19-19
Penalty for violation of chapter provisions
Operative Text
(a) Any person found guilty of violating any of the provisions of this chapter, upon conviction thereof, shall be punished by a fine of not less than $150.00 nor more than $250.00 for the first offense and not less than $300.00 nor more than $500.00 for the second and subsequent offenses in any 180-day period. All actions seeking the imposition of fines only shall be filed as quasi-criminal actions subject to the provisions of the Illinois Civil Practice Act (735 ILCS 5/1 et seq.). Repeated offense in excess of three within any 180-day period may also be punishable as a misdemeanor by incarceration in the county jail for a term not to exceed six months under the procedure set forth in Section 1-2-1.1 of the Illinois Municipal Code (65 ILCS 5/1-2-1.1), under the provisions of the Illinois Code of Criminal Procedure, in a separate proceedings. (b) Each failure to comply with the provisions of the section with respect to each person shall be considered a separate offense. A separate and distinct offense shall be regarded as committed each day during or on which such person shall continue or permit any such violation. (c) The rights, obligations and remedies set forth in this section shall be cumulative and in addition to any others available at law or in equity. The village or any prospective purchaser, purchaser or owner of a unit may seek compliance with any provision of this chapter and in addition shall have the right to rescind any sale not in substantial conformance with this section or may seek damages as permitted by law.
Stickney Ch. 19 § 19-19 establishes a tiered penalty structure for violations of the village's condominium conversion rules. A first offense carries a fine between $150 and $250, while a second or subsequent offense within any 180-day window carries a fine between $300 and $500. Repeated violations beyond three within 180 days can escalate to misdemeanor charges with potential jail time of up to six months, and each day a violation continues counts as a separate offense. Prospective buyers, current purchasers, and unit owners may also seek to rescind a non-conforming sale or pursue damages under applicable law.
Plain English — not legal advice.
Operators managing condominium conversions in Stickney should be aware that § 19-19 imposes escalating financial penalties for each breach of Chapter 19's requirements, with fines increasing significantly for repeat offenses within a 180-day period. Because each day of non-compliance is treated as a distinct offense, a single unresolved issue can quickly multiply into multiple violations. Compliant operators generally ensure that all conversion-related disclosures, notices, and procedural steps are completed accurately and on time, and that any identified deficiency is corrected promptly to avoid the misdemeanor threshold triggered by more than three offenses in 180 days.

Under Stickney Ch. 19 § 19-19, tenants and prospective purchasers of converted condominium units have standing to seek enforcement of Chapter 19's requirements directly, not just through village action. If a sale was not conducted in substantial conformance with the chapter's provisions, § 19-19(c) preserves the right to seek rescission of that sale or to pursue damages as permitted by law. Individuals who believe their rights under Chapter 19 have been violated may consider consulting a tenant-rights organization or a housing attorney to understand the full range of remedies available, including both civil and quasi-criminal enforcement paths.
