Stickney — Ch. 19 Condominium Conversions § 19-5
Property report; documents; receipt required
Operative Text
(a) Not later than the offering for sale of the first unit, a developer of a condominium of more than three units must: (1) Have a property report available for distribution to each prospective purchaser and for examination by the village. A developer may make a charge, not to exceed $2.00 for each report so distributed. (2) Make available for inspection by prospective purchasers, copies of all documents that were filed or required to be filed in connection with the condominium project, with the Recorder of Deeds of Cook County. (3) Keep a receipt signed by each purchaser acknowledging that the person entering a contract to purchase has received and has had an opportunity to review the property report. Such receipts are to be kept on file in the possession of the developer for a period of three years from the date of signature of the purchaser; and such receipts are subject to the inspection of the village at any reasonable time; (b) The board of managers of the condominium shall keep a copy of the latest property report for seven years following the date of the property report's initial distribution. Upon reasonable notice, the property report shall be made available for inspection by any prospective purchaser of a unit from a unit owner.
Under Stickney Ch. 19 Condominium Conversions § 19-5, before the first unit in a condominium development of more than three units is offered for sale, the developer must prepare a property report and make it available to prospective buyers and the village for review. Copies of all documents filed with the Cook County Recorder of Deeds in connection with the project must also be made available for inspection. Once units are sold, the condominium's board of managers takes on a long-term obligation to retain the property report and make it accessible to future prospective purchasers for seven years after its initial distribution.
Plain English — not legal advice.
Developers subject to § 19-5 of Stickney's Condominium Conversions chapter generally ensure the property report is ready for distribution before any unit is first offered for sale, and may charge no more than $2.00 per copy distributed. A compliant developer also maintains signed receipts from each purchaser confirming they received and had an opportunity to review the report, keeping those receipts on file for at least three years and making them available to the village upon request. After the development is established, the condominium board of managers typically retains the most current property report for seven years from its initial distribution date and makes it available to prospective unit purchasers upon reasonable notice.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Prospective buyers of condominium units covered by Stickney Ch. 19 § 19-5 have the right to receive a property report before entering into a purchase contract, and the developer is required to obtain a signed receipt confirming that opportunity was provided. If a unit is being purchased from an existing unit owner rather than the original developer, the condominium's board of managers is obligated to make the latest property report available for inspection upon reasonable notice. Individuals who believe these disclosure requirements have not been met may wish to contact the Village of Stickney directly, since the village retains inspection authority over both the property reports and the signed receipts, or consult a tenant- or buyer-rights organization for general guidance.
