Summit — Ch. 7-17 Rental Occupancy License Program § 7-17-10
Revocation Of Rental Occupancy License Or Code Compliance Report Due To Physical Defects In The Rental Unit
Operative Text
A rental occupancy permit or code compliance report may be immediately revoked at any time during the occupancy of the rental unit for which the code compliance report and/or rental occupancy permit has been issued, should the code enforcement officer determine, following a reasonable investigation, that the unit no longer complies with the provisions of this Chapter due to physical defects in the rental unit. Prior to revoking a rental occupancy permit and/or code compliance report, hereunder, the code enforcement officer shall provide the owner, agent or manager and the tenant with a written report stating the defects noted during the investigation and providing a reasonable time for the correction of said defects, except when the conditions of the unit pose an immediate threat to the life and safety of the occupants, in which case, upon application by the code enforcement officer, the Executive Director may issue an emergency notice of revocation to the owner, agent or manager and the tenant immediately and shall then cause the unit to be vacated without delay. Procedures for revocation of a rental occupancy permit or code compliance report shall be in accordance with section 7-17-12 of this Chapter, except in the case of an emergency notice of revocation. (Ord. 20-O-03, 1-6-2020)
Under Summit Ch. 7-17 § 7-17-10, a rental occupancy permit or code compliance report can be revoked mid-tenancy if a code enforcement officer determines, after reasonable investigation, that the unit has physical defects making it non-compliant with Chapter 7-17. Before revocation, the officer must give the owner and tenant a written report identifying the defects and a reasonable window to fix them. However, if conditions pose an immediate threat to life and safety, the Executive Director can issue an emergency revocation notice and order the unit vacated without delay, bypassing the standard correction period.

Property owners and managers operating under Summit Ch. 7-17 § 7-17-10 should be aware that a rental occupancy permit or code compliance report remains subject to revocation throughout a tenancy, not just at the time of issuance. Compliant operators generally maintain units in continuous conformance with Chapter 7-17 standards and respond promptly to any written defect report issued by the code enforcement officer within the time allowed for corrections. In cases where an emergency notice of revocation is issued, the Executive Director's order to vacate takes effect immediately, so operators typically have protocols in place to address urgent life-safety conditions as quickly as possible.

Under Summit Ch. 7-17 § 7-17-10, tenants have a right to receive written notice of any physical defects identified by the code enforcement officer before a rental occupancy permit or code compliance report is revoked, along with information about the time given to the owner to correct those defects. In emergency situations where the unit poses an immediate threat to life and safety, the Executive Director may order the unit vacated right away without waiting for corrections. Tenants who believe their unit has physical defects that may trigger this provision can contact Summit's code enforcement office, consult a local tenant-rights organization, or review the revocation procedures outlined in § 7-17-12 of the same chapter to understand available options.
