Urbana — Ch. 12.5 Landlord-Tenant Relationships § 12.5-46
Purpose and declaration of policy
Operative Text
If the city provides a landlord with written notice that a rental property or any dwelling unit located therein will be designated as unlawful to occupy due to conditions either created, or knowingly and willfully left unabated by the landlord which where the responsibility of the landlord to remedy, that violate one (1) or more applicable codes, statutes or ordinances the landlord shall pay relocation assistance to every displaced tenant household as provided for in sections 12.5-47 and 12.5-48 . However, no tenant whose own illegal or negligent conduct caused the conditions which require relocation shall be entitled to relocation assistance and no tenant whose right to possession has been terminated by court order shall be entitled to relocation assistance. For purposes of sections 12-5-46 through 12-5-51, "tenant household" shall mean an individual tenant who resides in a rental dwelling unit or two (2) or more individuals who lawfully reside in the same rental dwelling unit whether or not such individuals are related to one another by blood or marriage.
Under Urbana Ch. 12.5 § 12.5-46, when the city formally notifies a landlord in writing that a rental property or unit will be declared unlawful to occupy because of code, statute, or ordinance violations that the landlord created or knowingly allowed to persist, the landlord is required to pay relocation assistance to each displaced tenant household. This obligation does not extend to tenants whose own illegal or negligent conduct caused the conditions necessitating relocation, nor to tenants whose right to possession was ended by a court order. A 'tenant household' under this provision includes either a single tenant or multiple individuals lawfully sharing a unit, regardless of familial relationship.
Plain English — not legal advice.
Under § 12.5-46, a landlord who receives written notice from the City of Urbana that a property or unit will be designated unlawful to occupy due to code violations the landlord created or failed to remedy is generally responsible for providing relocation assistance to each affected tenant household as outlined in §§ 12.5-47 and 12.5-48. Compliant operators typically maintain rental units in code-conforming condition and address violations promptly to avoid circumstances that trigger this relocation-assistance obligation. Keeping thorough records of maintenance requests, repairs, and any city correspondence is a practice commonly associated with demonstrating responsiveness to code requirements.

Section 12.5-46 of Urbana's Landlord-Tenant Relationships ordinance establishes that tenants displaced because a landlord created or knowingly left unabated code violations may be entitled to relocation assistance from that landlord. If a tenant receives notice that their unit has been declared unlawful to occupy under these circumstances, they may have grounds to pursue the relocation assistance described in §§ 12.5-47 and 12.5-48. Tenants who believe they qualify can explore their options by contacting the City of Urbana's relevant housing or code-enforcement office or reaching out to a local tenant-rights organization for general information about the process.
