Westchester — Ch. 7.128 Rental Residential Property Inspection and Licensing § 7.128.040
Certificate of Inspection required
Operative Text
(a) It shall be unlawful for any person, firm, partnership, association, corporation, or other legal entity to operate, maintain or offer to rent or rent within the Village any Rental Residential Property, whether vacant or occupied, without first having obtained and maintained a current Certificate of Inspection, as provided in this chapter. (b) It shall be unlawful for any person to occupy a rental residential property, as defined in Section 7.128.030 herein, or for an Owner to allow anyone to occupy a rental residential property, as defined in Section 7.128.030 herein, which is not currently registered with the Village, as provided in this chapter. (c) This chapter shall not apply to the following structures: (1) Hotels, motels; (2) Dwellings, buildings, structures and uses licensed and inspected by the state or federal government, including, but not limited to, nursing homes, retirement communities and rest homes; (3) Dwellings, buildings and structures used or owned by other governmental agencies and public housing authorities and otherwise inspected by them for compliance; and (4) Dwelling units in rental residential property, all of which are leased to or inhabited by family members of the Owner.
Westchester Ch. 7.128 § 7.128.040 establishes that any rental residential property within the Village must hold a current Certificate of Inspection before it can be operated, maintained, offered for rent, or rented out — regardless of whether the unit is vacant or occupied. Separately, neither an owner nor a tenant may allow or permit occupancy of a rental unit that is not currently registered with the Village. Certain property types are carved out from these requirements, including hotels, motels, state- or federally-licensed facilities such as nursing homes, government-owned housing, and properties where all units are occupied exclusively by the owner's family members.
Plain English — not legal advice.
Under § 7.128.040, compliant rental property operators in the Village obtain and keep current a Certificate of Inspection before placing any unit on the market or allowing occupancy — this applies even when a unit sits vacant. Operators also ensure their properties remain registered with the Village throughout the rental period, not just at initial leasing. Reviewing the exemptions listed in § 7.128.040(c) is a common step for owners of mixed-use or family-occupied properties to determine whether the chapter's requirements apply to their specific holdings.

Section 7.128.040 gives tenants a basis to verify that their rental unit is properly registered and holds a current Certificate of Inspection, both of which are conditions the Village requires before lawful occupancy. If a unit lacks registration or a valid certificate, that may constitute a violation of this chapter by the owner. Tenants who believe their unit is out of compliance can generally contact the Village's relevant code enforcement or housing office, or reach out to a local tenant-rights organization, to understand what options exist under Ch. 7.128.
