Westmont — Ch. 19 Condominium Conversions § 19-1
It is concluded that equity ownership of multiple-family dwellings and office units is a positive development for the Village of Westmont (the "village") and, within certain limits, such ownership should be encouraged. Because of the unique nature of condominium ownership and the age of the existing multiple-family dwelling and office unit stock in the village, it is further concluded that the quality of housing and office units and the rights of the condominium purchaser should be protected to a greater extent than the protections provided under existing laws. To this end, the village has the authority to introduce regulation into the condominium process, as provided in the Condominium Property Act, 765 ILCS 605/1 et seq.
Based on the foregoing, the purpose and intent of this chapter is to introduce regulatory elements into the condominium conversion process that protect the rights of condominium purchasers and preserve and improve the quality of housing and office units in an effort to encourage orderly development of the condominium concept within the village. Further, this chapter is intended to facilitate code inspections by the village and, thus, to reduce the possibility of a condominium containing material defects that would have an adverse effect on the health, safety and welfare of its occupants or neighboring property, or would place unexpected burdens on condominium unit buyers.

Plain English

Westmont Chapter 19, Section 19-1 establishes the overarching purpose behind the village's condominium conversion regulations. The provision reflects the village's conclusion that condo ownership is a positive development worth encouraging, while also recognizing that older multi-family housing stock and the unique nature of condo ownership require protections beyond what state law already provides. To that end, the chapter introduces regulatory oversight into the conversion process — including code inspections — aimed at protecting buyers, preserving housing quality, and preventing material defects that could harm occupants or neighboring properties.

For Property Managers

Property owners and managers pursuing condominium conversions in Westmont should understand that Chapter 19, Section 19-1 sets the foundational intent behind all subsequent requirements in this chapter. Compliant operators generally engage proactively with the village's code inspection process, treating it as a built-in step rather than an obstacle, since the chapter is explicitly designed to surface material defects before units change hands. Familiarity with this stated purpose can help operators anticipate the spirit behind more specific requirements that follow in Chapter 19.

For Tenants

For prospective condominium purchasers in Westmont, Section 19-1 signals that Chapter 19 was enacted specifically with buyer protection in mind, going beyond the baseline protections available under Illinois state law. The provision's emphasis on code inspections and the prevention of material defects means that the conversion process is intended to give buyers greater assurance about the condition of a unit before purchase. Tenants or buyers who believe the protections described in Chapter 19 have not been followed may wish to contact the Village of Westmont directly or consult a tenant-rights organization familiar with Illinois condominium law.
