Plain English

Wheeling's Ch. 4.84 § 4.84.100 establishes three baseline responsibilities for rental property owners: keeping a record of every tenant's full legal name by unit, making available a 24-hour emergency contact with repair authority, and notifying each incoming tenant in writing of the maximum occupancy limit for their unit before they move in. The occupancy ceiling is set by the village's property maintenance code and determined by the code official. Together, these requirements create a minimum standard of accountability and transparency between owners and tenants.

For Property Managers

Under § 4.84.100, compliant rental operators in Wheeling generally maintain an up-to-date roster of tenants by unit using full legal names, ensure that a responsible person's name and phone number—someone reachable around the clock and empowered to authorize repairs—is on file and shared with tenants, and deliver a written occupancy-limit notice to each tenant before the lease begins. The maximum occupancy figure must come from the code official under the village property maintenance code, so operators typically confirm that number before preparing move-in documents. Keeping dated copies of all written disclosures supports a clear record of compliance with § 4.84.100.

For Tenants

Section 4.84.100 gives Wheeling renters the right to receive, before moving in, a written statement of the maximum number of occupants permitted in their unit under the village property maintenance code. Tenants are also entitled to the name and phone number of a responsible person who can be reached any hour of the day and who has the authority to arrange repairs in an emergency. If these disclosures were not provided, tenants may wish to contact the village's code enforcement office, consult a local tenant-rights organization, or explore whether the omission is relevant to any dispute arising under Ch. 4.84.
