Wheeling — Ch. 4.84 Rental Residential Property § 4.84.120
(a) Prior to an inspection, the lessee/occupant must sign a consent form authorizing the village of Wheeling to conduct an inspection and if required, reinspections to ensure compliance with Chapter 4.84 of the Wheeling Municipal Code.
(b) If any owner, property agent, occupant or other person in control of a rental residential property or a dwelling unit contained therein fails or refuses to consent to free access and entry to the property or dwelling unit under his control for any inspection pursuant to this Chapter, the code official or his designee may apply to the circuit court for a search warrant or other appropriate court order authorizing such inspections.

Plain English

Under Wheeling Municipal Code § 4.84.120, the Village of Wheeling's rental property inspection program requires that a lessee or occupant sign a consent form before an inspection — and any necessary reinspections — can take place. If any owner, agent, occupant, or other person in control of the property refuses to grant access, the code official is authorized to seek a search warrant or court order from the circuit court to proceed with the inspection. This provision balances the municipality's interest in code compliance with the legal requirement to obtain either consent or judicial authorization before entering a dwelling.

For Property Managers

Property owners and managers operating under § 4.84.120 of the Wheeling Municipal Code generally ensure that the inspection process is coordinated with occupants so that signed consent forms are obtained before any scheduled inspection or reinspection. Compliant operators typically communicate clearly with tenants about the purpose and timing of inspections required under Chapter 4.84. Refusing or obstructing access does not prevent an inspection from occurring, as the code official retains the authority to pursue a court-authorized search warrant.

For Tenants

Under § 4.84.120 of the Wheeling Municipal Code, tenants have a role in the inspection process — a signed consent form from the lessee or occupant is required before the Village of Wheeling may conduct an inspection or reinspection of the dwelling unit. Tenants who have questions about what they are consenting to, or about the scope of an inspection under Chapter 4.84, may wish to review the municipal code directly or consult a tenant-rights organization familiar with Wheeling regulations. It is worth knowing that if consent is withheld, the village has a legal pathway to obtain a court order authorizing the inspection.
