Yorkville — Title 8 Ch. 5 Condominium Conversions § 8-5-2
State law adopted:
Operative Text
The City, in the interest of protection of those persons occupying residential rental units and affording them the same rights and privileges that are set forth in the statutes enacted by the State of Illinois, hereby ratifies and enacts as an ordinance of the City an act concerning the ownership in and rights and responsibilities of parties under the condominium form of ownership of real property enacted by the state legislature under the Condominium Property Act on June 20, 1963, and all amendments thereto. State Law reference-- S.H.A. 765 ILCS 605/1 et seq.
Section 8-5-2 of Yorkville's Title 8, Chapter 5 formally incorporates Illinois's Condominium Property Act (765 ILCS 605/1 et seq.) into local law. By doing so, the City of Yorkville extends to residents of residential rental units the same rights and protections that state law provides to parties involved in condominium ownership. Any amendments the Illinois legislature makes to that Act are also folded into Yorkville's local ordinance by this provision.

Under § 8-5-2, property owners and managers involved in condominium conversions in Yorkville are expected to operate in compliance with both the City's local ordinance and the underlying Illinois Condominium Property Act (765 ILCS 605/1 et seq.). Compliant operators generally familiarize themselves with the full scope of the state statute, including any legislative amendments, since Yorkville has adopted those amendments by reference. Maintaining awareness of both the local and state-level requirements helps ensure that the rights of existing residential tenants are properly observed during any conversion process.

Section 8-5-2 means that residents of Yorkville rental units affected by a condominium conversion are entitled to the full set of rights and protections established under the Illinois Condominium Property Act (765 ILCS 605/1 et seq.), as adopted by the City. Tenants who believe those rights have not been honored may consider raising the violation in any relevant legal or administrative proceeding, or reaching out to a local tenant-rights organization for general information. Illinois's state housing resources and local municipal offices can also be consulted to better understand what protections apply under this provision.
