Under Benton Harbor, MI Code of Ordinances § 20-113, landlords are required to give tenants a copy of all rules and regulations governing the use, occupancy, and maintenance of the rental unit before or within seven days of entering into a rental agreement — no request from the tenant is needed. Landlords must also provide the official "Notice to Tenants," which informs tenants of their right to report housing code concerns to the city's Department of Building and Inspection. A written acknowledgment confirming the tenant received both documents must be obtained by the landlord.

Operators subject to § 20-113 of the Benton Harbor Landlord-Tenant Code generally provide new tenants with a complete copy of all applicable rules and regulations, along with the prescribed "Notice to Tenants," at or before lease signing — and no later than seven days after the agreement is entered into. Compliant operators do not wait for a tenant to ask for these materials; delivery is required regardless of any request. Retaining a signed written acknowledgment from each tenant confirming receipt of both documents is a standard practice for demonstrating compliance with § 20-113.

Under § 20-113 of the Benton Harbor Landlord-Tenant Code, tenants are entitled to receive a copy of the property's rules and regulations and the city's "Notice to Tenants" at or within seven days of signing a lease, without having to ask. The "Notice to Tenants" itself outlines a path for addressing housing or building code concerns: first notifying the landlord in writing and keeping a copy, and then contacting the Benton Harbor Department of Building and Inspection at 200 Wall Street if the issue remains unresolved. Tenants who did not receive these materials may wish to document that fact and consult a local tenant-rights organization to understand what options may be available under § 20-113.
