Under Detroit — Ch. 22 Art. X Right to Counsel in Eviction Proceedings § 22-10-8, the Right to Counsel program and its services exist only to the extent that Detroit City Council approves and appropriates funding. Through December 31, 2026, the City may draw on county, state, or federal sources—including American Rescue Plan Act funds—as well as private funds to run the program. After that date, the City may use any legally permissible funding sources, again subject to City Council approval and appropriation.

Detroit — Ch. 22 Art. X Right to Counsel in Eviction Proceedings § 22-10-8 establishes that the Right to Counsel program is contingent on City Council appropriations, meaning the scope and availability of tenant legal services can change from year to year. Property owners and managers who handle eviction proceedings in Detroit generally stay informed about whether the program is currently funded and operational, since that affects whether tenants may appear with counsel. Operators familiar with this funding structure are better positioned to anticipate the procedural landscape in eviction cases.

Detroit — Ch. 22 Art. X Right to Counsel in Eviction Proceedings § 22-10-8 makes clear that the free legal representation program for tenants facing eviction depends on ongoing City Council appropriations, so its availability is not guaranteed in perpetuity. Tenants who believe they may qualify for program services can contact local tenant-rights organizations or the City of Detroit to confirm whether funding is currently active and services are being provided. If the program is operational, tenants facing eviction proceedings may have access to legal counsel at no cost, and understanding the program's funding status is a useful first step in exploring available options.
