Grand Rapids — Ch. 160 Discrimination in Real Property Transactions § 9.365
Exemptions
Operative Text
The provisions of Section 9.364 do not apply: (1) To the rental of a housing accommodation in a building which contains housing accommodations for not more than two (2) families living independently of each other, if the lessor or a member of his or her family resides in one (1) of the housing accommodations; or (2) To the rental of a room or rooms in a single dwelling unit by an individual if he or she or a member of his or her family resides therein.
Section 9.365 of Grand Rapids Chapter 160 carves out two narrow exemptions from the anti-discrimination rules established in Section 9.364. The first exemption applies to small two-family buildings where the owner or a family member actually lives in one of the units. The second exemption applies when an individual rents out a room or rooms within a dwelling where they or a family member personally resides. Outside these specific circumstances, the full protections of Section 9.364 remain in effect.
Plain English — not legal advice.
Under § 9.365, property owners who live in one unit of a two-family building, or who rent out rooms within their own personal residence, may fall outside the scope of Section 9.364's anti-discrimination requirements. Operators who claim this exemption generally maintain clear documentation that they or a qualifying family member genuinely occupy the relevant unit or dwelling. Landlords managing larger properties or those who do not personally reside on-site should not assume this exemption applies to their operations.

Section 9.365 means that some small, owner-occupied rental situations are not covered by the anti-discrimination protections of Section 9.364, which can affect the remedies available to a tenant in those settings. Tenants who believe they have experienced discriminatory treatment should consider whether their housing situation falls within or outside these exemptions before determining how to proceed. Local tenant-rights organizations or the Grand Rapids city government can help clarify whether a specific rental arrangement qualifies for an exemption under § 9.365.
