Bloomington, Minn., Code of Ordinances § 15 § 15.83
PENALTY (Bloomington Buildings and Structures Code)
Operative Text
A violation of any provision in this Division A shall be a misdemeanor. In addition, the city may enforce this Division A by injunctive action or other appropriate civil remedy. (Ord. 2002-1, passed 1-14-2002)
Section 15.83 of Bloomington's Code of Ordinances establishes that any violation of Division A's rental housing provisions constitutes a misdemeanor under Minnesota law, which can carry criminal consequences. Beyond criminal prosecution, the city retains the authority to pursue civil remedies, including injunctive relief, to compel compliance or stop ongoing violations. This dual enforcement framework means a single violation could trigger both criminal and civil proceedings simultaneously.
Plain English — not legal advice.
Under § 15.83, operators of rental properties in Bloomington are expected to maintain full compliance with every provision in Division A, since any breach is classified as a misdemeanor—not merely a civil infraction. Compliant operators typically conduct regular self-audits of their practices against Division A's requirements and address any deficiencies promptly. Because the city can also seek injunctive relief under this section, unresolved violations may result in court orders requiring immediate corrective action.

Section 15.83 gives the City of Bloomington meaningful enforcement tools to address landlord violations of Division A, including the ability to pursue criminal misdemeanor charges and civil court remedies such as injunctions. Tenants who believe a landlord has violated Division A may report the concern to the city, which can then initiate enforcement action on its own authority. Tenant-rights organizations in the Bloomington area can help residents understand how this provision interacts with other protections and what reporting options are generally available.
