(2) That the certification requirement imposed by this section shall not apply if the owner or other natural person as defined in section 244.1840 (3) responsible for the maintenance of the premises provides a report from a professional risk assessment performed by an independent risk assessor demonstrating that no paint from the area in need of repair contains lead. The report must be approved by the director of inspections or the director's designee. ( 2007-Or-052 , § 1, 7-20-07; 2011-Or-022 , § 1, 3-10-11; 2013-Or-159 , § 3, 12-6-13)
Minneapolis Code of Ordinances § 12 § 240.100 addresses how violations involving deteriorating interior paint in pre-1978 rental dwellings, rooming houses, and lodging establishments must be handled. When a notice of violation is issued for blistered, cracked, flaked, scaled, or chalked-away interior paint, the notice must inform the recipient that anyone performing or supervising the repair work is generally required to hold EPA Lead Renovation, Repair and Painting (RRP) Program certification under 40 CFR Part 745. This certification requirement can be waived if an independent risk assessor's report—approved by the director of inspections—confirms that the affected paint area contains no lead.
Plain English — not legal advice.
Operators of pre-1978 rental properties in Minneapolis should be aware that § 12 § 240.100 ties directly to the violation-notice process: if the commissioner of health or fire chief issues a notice for deteriorating interior paint, the notice will spell out that workers or supervisors performing the remedial repairs are expected to carry EPA RRP certification. Compliant operators typically verify certification credentials before repair work begins and retain documentation for inspection. Alternatively, owners can commission an independent lead risk assessment; if the approved report confirms no lead is present in the affected area, the certification requirement under this section does not apply.

Tenants living in Minneapolis rental housing built before 1978 have an interest in § 12 § 240.100 because it sets requirements designed to protect occupants when deteriorating paint is repaired. If a notice of violation has been issued for blistered, cracked, or flaking interior paint at a property, tenants can ask to see documentation of the repair workers' EPA RRP certification or the approved lead-free risk assessment report. Tenants who believe these requirements are not being followed may consider contacting the Minneapolis Department of Regulatory Services or a local tenant-rights organization to understand available options.
