Plain English

Minneapolis Code of Ordinances § 244.1105 establishes that city inspectors have the authority, derived from Minnesota Statutes § 157.04, to enter lodging establishments during business hours without advance notice in order to check whether the property is meeting the requirements of the chapter. The provision does not require the inspector to schedule an appointment or obtain the operator's permission before entering. This access right is limited to times when the business is actively being conducted on the premises.

For Property Managers

Under § 244.1105, compliant lodging establishment operators generally maintain their properties in a condition that can withstand an unannounced inspection at any time during business operations. Operators typically ensure that all areas subject to the chapter's requirements are accessible and that staff are aware that authorized city inspectors may request entry. Keeping records of maintenance, licensing, and compliance measures on-site can help demonstrate adherence to the chapter's standards during such visits.

For Tenants

Section § 244.1105 gives city inspectors the right to enter lodging establishments during business hours to verify that the property meets the standards set out in the chapter, which can serve as a mechanism for identifying conditions that affect guests and residents. If you believe a lodging establishment is not meeting the chapter's requirements, you may consider contacting the City of Minneapolis to inquire about requesting an inspection or filing a complaint. Tenant-rights organizations familiar with Minneapolis housing and lodging regulations can help explain what options may be available under this provision.
