Minneapolis, Minn., Code of Ordinances § 12 § 244.170
Warning notice of insanitary condition (Minneapolis Housing Code)
Operative Text
All personnel of the solid waste and recycling division of the public works department shall take note of any insanitary conditions caused by accumulation of garbage, rubbish or other debris upon any premises serviced by them and shall report such conditions to their supervisors who shall cause a "warning notice" of such conditions to be served upon the owner or occupant of the premises, either by mail or by leaving such notice in a conspicuous place on the premises. Such notice shall be on a form to be prepared by the director of public works and a record of all such notices served shall be transmitted to the director of regulatory services for further inspection and enforcement of the provisions of the housing maintenance code. The service of any notice pursuant to this section shall not in any way supersede or affect any other order, tag or notice of violation duly issued or served pursuant to any other ordinance. (Code 1960, As Amend., § 67.060; 2013-Or-161, § 8, 12-6-13; Ord. No. 2017-063 , § 1, 11-3-17)
Minneapolis Code of Ordinances § 244.170 establishes a reporting and notification process for unsanitary conditions involving garbage, rubbish, or debris on properties served by the city's solid waste and recycling division. When division personnel observe such conditions, they are required to report them up the chain of command, triggering a formal 'warning notice' delivered to the property owner or occupant by mail or posted visibly on the premises. Records of these notices are forwarded to the director of regulatory services for potential follow-up inspection and enforcement under the housing maintenance code, and the issuance of such a notice does not cancel or replace any other outstanding violation orders.
Plain English — not legal advice.
Under § 244.170, property owners and managers are generally expected to keep their premises free of accumulated garbage, rubbish, and debris to avoid triggering the city's warning notice process. A warning notice issued under this section is transmitted to the director of regulatory services and can lead to further inspection and enforcement action under the housing maintenance code. Operators who maintain clean, debris-free properties and respond promptly to any warning notices they receive are better positioned to avoid escalating code enforcement proceedings.

Section § 244.170 gives occupants of a property a right to receive a warning notice—either by mail or posted conspicuously on the premises—when city solid waste personnel observe unsanitary conditions caused by accumulated garbage or debris. Tenants who receive such a notice should be aware that the record is forwarded to the director of regulatory services, which can lead to further inspection under the housing maintenance code. Those with questions about their rights or responsibilities in connection with a warning notice may find it helpful to consult a local tenant-rights organization or review Minneapolis's housing maintenance code provisions.
