Minneapolis, Minn., Code of Ordinances § 12 § 244.2140
Notice of sale (Minneapolis Housing Code)
Operative Text
When a transfer of ownership occurs, the new owner shall within thirty (30) days deliver written notice to each affordable housing dwelling unit tenant of the building that the property is under new ownership and all of the following information: (1) Name, phone number, and mailing address of the new owner. (2) The following statement: "Minneapolis Code of Ordinances section 244.2130 provides for a three (3) month tenant protection period for affordable housing dwelling unit tenants. Under section 244.2130 , an affordable housing dwelling unit tenant may be entitled to relocation assistance from the new owner if the new owner terminates or does not renew the tenant's rental agreement without cause within the three (3) month tenant protection period. An affordable housing dwelling unit tenant may also be entitled to relocation assistance from the new owner if the tenant terminates their rental agreement because the new owner raises the rent or initiates a tenant rescreening process within the three (3) month tenant protection period." (3) Whether there will be any rent increase within the three (3) month tenant protection period with the amount of the rent increase and the date the rent increase will take effect. (4) Whether the new owner will require existing affordable housing dwelling unit tenants to be rescreened to determine compliance with existing or modified residency screening criteria during the three (3) month tenant protection period and, if so, a copy of the screening criteria. (5) Whether the new owner will terminate or not renew rental agreements without cause during the three (3) month tenant protection period and, if so, notice to the affected affordable housing dwelling unit tenants whose rental agreements will terminate and the date the rental agreements will terminate. (6) Whether the new owner intends to increase rent, require existing affordable housing dwelling unit tenants to be rescreened to determine compliance with existing or modified residency screening criteria, or terminate or not renew affordable housing dwelling unit rental agreements without cause on the day immediately following the tenant protection period. This same written notice shall be furnished to the director of regulatory services at the same time notice is delivered to tenants. The new owner or member of the prior owner of an affordable housing building shall not terminate or not renew a tenant's rental agreement without cause, raise rent, or rescreen existing tenants during the tenant protection period without providing the notices required by this section. ( Ord. No. 2018-063 , § 1, 11-2-18)
Minneapolis Code of Ordinances § 244.2140 requires that when an affordable housing building changes ownership, the new owner must deliver a written notice to every affordable housing dwelling unit tenant within 30 days of the transfer. That notice must include the new owner's contact information, a standardized statement about the three-month tenant protection period under § 244.2130, and specific disclosures about any planned rent increases, rescreening requirements, or lease terminations during or immediately after that protection period. A copy of the same notice must simultaneously be filed with the city's director of regulatory services, and no covered action—such as raising rent, rescreening tenants, or ending leases without cause—may occur during the protection period unless the required notices have first been provided.
Plain English — not legal advice.
Under Minneapolis Code of Ordinances § 244.2140, a new owner of an affordable housing building generally delivers the mandated written notice to each covered tenant within the 30-day post-closing window, ensuring it contains all six required disclosures, including the verbatim statutory statement about § 244.2130 protections. Compliant operators also submit the identical notice package to the director of regulatory services at the same time it goes to tenants. Operators typically refrain from implementing rent increases, rescreening processes, or no-cause lease terminations during the three-month tenant protection period until all notice obligations under § 244.2140 have been fully satisfied.
General guidance for property managers — not legal advice for your specific situation. Consult an attorney for advice on your case.
Minneapolis Code of Ordinances § 244.2140 entitles affordable housing dwelling unit tenants to receive written notice from a new owner within 30 days of a property sale, covering key details such as the owner's contact information, any planned rent changes, rescreening plans, and lease termination intentions. If a new owner fails to provide this notice before taking actions like raising rent or ending a lease without cause during the three-month protection period, that failure may be relevant to any rights or remedies available under § 244.2130, including potential relocation assistance. Tenants who believe they have not received the required notice under § 244.2140 may consider contacting the Minneapolis Department of Regulatory Services or reaching out to a local tenant-rights organization to understand available options.
