Implied warranties (Minneapolis Housing Code)
Operative Text
(a) A declarant warrants that a unit will be in at least as good condition at the earlier of the time of the conveyance or delivery of possession as it was at the time of contracting, reasonable wear and tear excepted. (b) A declarant impliedly warrants that a unit and the common elements in the condominium are suitable for the ordinary uses of real estate of its type and that any improvements made or contracted for by the declarant or made by any person in contemplation of the creation of the condominium will be: (1) Free from defective materials; and (2) Constructed in accordance with applicable law, according to sound engineering and construction standards, and in a professional manner. (c) In addition, a declarant warrants to a purchaser of a unit which may be used for residential use that an existing use, continuation of which is contemplated by the parties, does not violate applicable law at the earlier of the time of conveyance or delivery of possession. (d) Warranties imposed by this section may be excluded or modified as specified in section 250.80 . (e) For purposes of this section, improvements made or contracted for by an affiliate of a declarant are made or contracted for by the declarant. (f) Any conveyance of a unit transfers to the purchaser all or any of declarant's implied warranties of quality. (79-Or-209, § 1, 10-26-79; Pet. No. 252271, § 48, 5-11-90)
Minneapolis Code of Ordinances § 12 § 250.70 establishes a set of implied warranties that a condominium declarant (typically the developer or seller) makes to purchasers. These warranties cover the physical condition of a unit at the time of transfer, the suitability of the unit and common elements for ordinary real-estate use, and the quality of construction—requiring that improvements be free from defective materials and built in compliance with applicable law and sound engineering standards. For residential units, the declarant also warrants that any existing, contemplated use is lawful at the time of conveyance or possession. These warranties automatically pass to the purchaser upon any conveyance of the unit, though they may be excluded or modified under the terms set out in § 250.80.
Plain English — not legal advice.
Declarants and developers operating under Minneapolis Code of Ordinances § 12 § 250.70 generally ensure that units are delivered in at least the same condition as when the purchase contract was signed, accounting for reasonable wear and tear. Compliant operators document that all improvements—whether made directly or through affiliates—use non-defective materials and conform to applicable law and recognized construction standards. Because these warranties transfer automatically to purchasers upon conveyance, declarants who wish to limit or exclude any warranty typically do so explicitly and only in the manner permitted by § 250.80.

Purchasers of condominium units in Minneapolis receive the protections of § 12 § 250.70 automatically, including assurances about the unit's condition at delivery, the quality of construction, and the lawfulness of any existing residential use. If a unit or its common elements appear to fall short of these implied warranties—such as through defective materials or code violations—buyers generally have the option of raising the warranty as a basis for a claim, consulting a tenant- or homeowner-rights organization, or seeking guidance from a local housing authority. Because § 250.70 also allows warranties to be modified or excluded under § 250.80, reviewing the purchase agreement carefully is a common first step in understanding the full scope of protections that apply.
