Rochester, Minn., Code of Ordinances § 7 § 7-2-4 establishes a limited exemption for older buildings that were constructed in full compliance with the code in effect at the time they were built, have been properly maintained, and continue to be used only for their originally permitted purpose. Such buildings are not required to meet the full minimum floor area standards—those requirements are reduced by ten percent. Additionally, existing exit and egress arrangements in these buildings may be accepted as adequate if the director of community development approves them, even if they do not fully conform to current residential building code, provided they align with applicable fire code provisions.

For Property Managers

Operators of pre-existing dwellings in Rochester should verify whether their properties qualify for the exemptions outlined in Rochester, Minn., Code of Ordinances § 7 § 7-2-4, which requires that the building was constructed in full compliance with the code then in force, has been continuously and properly maintained, and is used only for its originally permitted purpose. Compliant operators typically document the building's construction history and maintenance records to support any claim of exemption. For egress arrangements that differ from current residential building code standards, operators generally seek written approval from the director of community development and confirm alignment with applicable fire code provisions.

For Tenants

Under Rochester, Minn., Code of Ordinances § 7 § 7-2-4, tenants living in older buildings should be aware that their building may be operating under reduced floor area requirements or alternative egress standards if it qualifies for the pre-existing dwelling exemption. This exemption applies only when specific conditions are met—including original code compliance, proper maintenance, and use consistent with the original permitted purpose—so tenants who have concerns about whether those conditions are actually satisfied may consider raising the issue with local housing authorities or a tenant-rights organization. If egress or space conditions appear unsafe or substandard, tenants can inquire with the Rochester director of community development about whether any approval for alternative egress has been granted under this provision.
