Rochester, Minn., Code of Ordinances § 7 § 7-3-26
Notice to person responsible (Rochester Housing Code)
Operative Text
Whenever the code official determines that there has been a violation of this Code or has grounds to believe that a violation has occurred, notice shall be given in the manner prescribed in sections 7-3-27 and 7-3-28 to the person responsible for the violation as specified in this Code. Notices for condemnation procedures shall also comply with section 7-3-40 . (1) Whenever the director of community development finds that an emergency exists which requires immediate action to protect the public health or and safety, the director may, without notice or hearing, issue to the owner of the property an order reciting the existence of such an emergency and requiring the owner to take such action as the director deems necessary to meet the emergency. Notwithstanding the other provisions of the housing code, such order shall be effective immediately and any person to whom such order is directed shall comply therewith immediately, but upon petition to the director of community development shall be afforded a hearing in the manner prescribed in sections 7-5-12 through 7-5-23 . After such hearing, the board shall continue such order in effect, or modify it, or revoke it. (2) The abatement procedure in section 7-3-25 shall apply if the property owner fails to comply with the emergency order within the timelines established above.
Rochester, Minn., Code of Ordinances § 7 § 7-3-26 establishes two tracks for addressing housing code violations. Under the standard track, the code official must provide written notice to the responsible party before enforcement proceeds, following the procedures set out in related sections. Under the emergency track, the Director of Community Development can issue an immediate compliance order without prior notice or hearing when public health or safety is at risk, though the affected party may petition for a hearing afterward; if the property owner fails to comply, the abatement procedure under § 7-3-25 may be triggered.

Property owners and managers operating in Rochester should be aware that Rochester, Minn., Code of Ordinances § 7 § 7-3-26 authorizes two distinct enforcement pathways. In routine cases, a compliant operator responds promptly to any written notice of violation delivered under §§ 7-3-27 and 7-3-28, addressing the cited conditions within the stated timeframes. When an emergency order is issued directly by the Director of Community Development, compliance is required immediately upon receipt, and owners who do not act within the established timelines risk the city initiating abatement under § 7-3-25.
