Plain English

Rochester, Minn., Code of Ordinances § 7-4-45 identifies a specific set of structural and foundational conditions that are legally classified as 'unsafe' in existing buildings. These include situations where structural members, foundations, stairs, balconies, guards, and similar elements cannot adequately bear required loads or resist load effects. When any of these conditions are found, the building or affected component must be repaired or replaced to meet the International Building Code or International Existing Building Code standards, unless an approved alternative method substantiates compliance or demolition of the unsafe condition is authorized by the code official.

For Property Managers

Under Rochester, Minn., Code of Ordinances § 7-4-45, compliant property operators routinely inspect structural members, foundation systems, stairs, landings, balconies, guards, and handrails to confirm they remain capable of supporting required loads and resisting load effects. When a deficiency is identified, operators generally document the condition, engage a qualified professional to assess it against International Building Code or International Existing Building Code standards, and complete repairs or replacements before the condition worsens. Operators who believe an alternative compliance method is appropriate typically seek approval from the code official before proceeding, as the ordinance does allow for approved exceptions.

For Tenants

Rochester, Minn., Code of Ordinances § 7-4-45 establishes that certain structural deficiencies—such as compromised stairs, balconies, handrails, foundation problems, or overloaded structural members—are legally defined as unsafe conditions that must be corrected. Tenants who observe these types of conditions in their building may report them to Rochester's code enforcement office, which has authority to require the property owner to make repairs or replacements. Tenant-rights organizations and legal aid services can help tenants understand how a documented violation under § 7-4-45 might be relevant to habitability concerns or other housing remedies available under local and state law.
