Rochester, Minn., Code of Ordinances § 7 § 7-9-12
Failure to register (Rochester Housing Code)
Operative Text
Every person required to register a dwelling, apartment, or rooming unit under the provisions of this chapter, and who fails to do so, or who allows the property to be occupied when the registration certificate or right to receive such registration certificate is revoked or suspended, shall be guilty of a violation of this Code. Each day that a property is rented out without a valid rental registration certificate on file for that property is a separate violation. A violation of this section shall be penalized as noted in section 7-3-6 (8).
Rochester, Minn., Code of Ordinances § 7-9-12 establishes that any person who is required to register a rental dwelling, apartment, or rooming unit but fails to do so — or who allows a property to be occupied while its registration certificate is revoked or suspended — commits a code violation. Each day the property is rented without a valid registration certificate on file counts as a separate, independent violation. The penalty for each such violation is determined by reference to section 7-3-6(8) of the same code.

Under § 7-9-12, compliant rental property operators in Rochester, Minnesota maintain a current, valid rental registration certificate for every dwelling, apartment, or rooming unit they rent out, and they do not allow occupancy to continue if that certificate has been revoked or suspended. Because each day of non-compliant rental activity constitutes its own separate violation, operators generally treat registration renewal and status monitoring as a routine, time-sensitive administrative obligation. Penalties are assessed according to section 7-3-6(8), so property managers typically confirm their registration standing before placing or renewing any tenancy.

Rochester, Minn., Code of Ordinances § 7-9-12 provides that tenants have an interest in knowing whether the unit they occupy is covered by a valid rental registration certificate, since renting an unregistered unit — or one whose certificate has been revoked or suspended — constitutes a code violation by the landlord. Tenants who believe their unit may lack proper registration can contact the City of Rochester's code enforcement or housing inspection office to inquire about a property's registration status. If a violation is confirmed, tenants may wish to consult a tenant-rights organization or legal aid provider to understand how § 7-9-12 and the associated penalty provisions under section 7-3-6(8) may be relevant to their situation.
