Rochester, Minn., Code of Ordinances § 7 § 7-9-15
Legislative intent (Rochester Housing Code)
Operative Text
(a) It is declared to be the purpose and intent of sections 7-9-15 through 7-9-18 to protect and preserve this city's neighborhoods and the public health, safety, welfare and morals of those who live there. The common council determined that: (1) There are persons residing in rental property in the city engaging in disorderly conduct which results in a hostile environment for other citizens living close to the rental property; (2) There is currently no city ordinance which provides a formal procedure by which the city can notify a rental property owner or manager of the disorderly conduct occurring on the property; (3) There is currently no procedure by which the city can require a rental property owner or manager to respond to and resolve the occurrences of disorderly conduct occurring on his rental property and to take administrative action against his rental registration certificate or right to obtain a rental registration certificate should he fail to do so. (b) Accordingly, it is the intent of sections 7-9-15 through 7-9-18 to address the serious and, at times, life-threatening problems posed by the occurrence of disorderly conduct to the health and safety of all city residents in all portions of the city. At the same time, the common council recognizes, acknowledges, and complies with all due process and property rights enjoyed by those who own or manage rental property as well as those who reside in such property. This title represents the city's good faith effort to balance those competing and legitimate interests.
Rochester, Minn., Code of Ordinances § 7 § 7-9-15 establishes the legislative purpose behind the city's disorderly conduct rules for rental properties. The provision explains that the city identified a gap in local law: there was no formal process to notify rental property owners of disorderly conduct on their properties or to require them to address it. Sections 7-9-15 through 7-9-18 were enacted to protect neighborhood health, safety, and welfare while also respecting the due process and property rights of both owners and residents.

Rochester, Minn., Code of Ordinances § 7 § 7-9-15 signals that the city created a formal framework—spanning through § 7-9-18—specifically to hold rental property owners and managers accountable for disorderly conduct occurring on their properties. Compliant operators generally stay informed about the notification and response procedures established under this framework, so they are prepared to act if the city contacts them about a conduct issue. Understanding the legislative intent behind these sections helps property managers appreciate that the ordinance is designed to balance neighborhood safety with the due process rights of owners.
