Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-136, every occupancy record card for a rooming house, second-class dwelling, hotel, or nursing home must document both the total maximum number of occupants allowed across all units and the maximum occupancy for each individual unit. When a certificate of occupancy is also required under the related provisions, all units listed on the card must fall within the portions of the building that the certificate authorizes for habitation. This rule creates a written record that ties permitted occupancy limits to specific spaces within a dwelling.

For Property Managers

Operators of rooming houses, second-class dwellings, hotels, and nursing homes in Bellevue are generally expected to maintain occupancy record cards that satisfy § 15-136 by clearly stating both the aggregate and per-unit occupancy maximums. Where a certificate of occupancy is required under § 15-172, compliant operators ensure that every unit listed on the card is located within the portions of the building covered by that certificate. Keeping these records accurate and up to date is a standard part of permit compliance under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-136.

For Tenants

Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-136 establishes that the occupancy record card for your building should show the maximum number of people permitted in your individual unit as well as across the entire facility. If a unit you occupy is not listed within the portions of the building authorized by a certificate of occupancy, that may represent a compliance issue under this provision. Tenants who have questions about whether their unit is properly documented can review the occupancy record card, contact the relevant Bellevue municipal authority, or reach out to a local tenant-rights organization for general guidance.
