Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. V § 15-145, any rooming unit, second-class dwelling unit, hotel unit, or nursing home unit that contains only one habitable room is generally limited to a maximum of four occupants. An exception exists for hotel and nursing home units: those types of units may house more than four occupants if they satisfy the other applicable requirements of the same chapter. The rule sets a clear occupancy ceiling tied to the physical configuration of the unit rather than its square footage alone.

For Property Managers

Operators of rooming houses, second-class dwellings, hotels, and nursing homes in Bellevue should be aware that § 15-145 caps occupancy at four persons in any single-habitable-room unit. Compliant operators of hotel or nursing home properties who wish to allow higher occupancy generally ensure that the unit meets all other standards set out elsewhere in Chapter 15 before permitting additional residents. Keeping occupancy records and conducting periodic unit inspections are practices commonly associated with maintaining compliance with this provision.

For Tenants

Section 15-145 of the Bellevue Code of Ordinances establishes that tenants living in a one-habitable-room rooming unit, second-class dwelling, hotel unit, or nursing home unit have a right to housing that is not overcrowded beyond four occupants under most circumstances. If a tenant believes a unit is being occupied in violation of this limit, general enforcement paths include reporting the concern to the local code enforcement or housing inspection office in Bellevue. Tenant-rights organizations familiar with Nebraska housing law can help residents understand how this provision may apply to their living situation.
