Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-160
APPLICABILITY OF OTHER SECTIONS TO SECOND CLASS DWELLINGS
Operative Text
No person shall operate a second class dwelling and no person shall occupy any second class dwelling unit in a second class dwelling unless all of the requirements of sections 15-97--15-122 and article III of this chapter are complied with. (Code 1964, § 12A-34)
Section 15-160 of Bellevue, Nebraska's Code of Ordinances establishes that second class dwellings are subject to the same baseline requirements found in sections 15-97 through 15-122 and Article III of Chapter 15. The provision prohibits both the operation of such a dwelling and its occupancy unless those referenced standards are fully met. In effect, the classification of a dwelling as 'second class' does not exempt it from the city's broader housing code obligations.
Plain English — not legal advice.
Operators of second class dwellings in Bellevue must ensure full compliance with sections 15-97 through 15-122 and Article III of Chapter 15 before allowing any unit to be occupied. Under § 15-160, the 'second class' designation carries no reduced standard — all referenced code requirements apply equally. Compliant operators typically conduct regular inspections of their properties against each applicable section to confirm ongoing adherence before and during any tenancy.

Under § 15-160 of Bellevue's Code of Ordinances, tenants living in or considering occupying a second class dwelling unit are protected by the full set of standards in sections 15-97 through 15-122 and Article III of Chapter 15. If a unit does not meet those requirements, the provision makes both its operation and occupancy impermissible. Tenants who believe their dwelling falls short of these standards may consider contacting Bellevue's local code enforcement office, reviewing the referenced sections of Chapter 15, or reaching out to a tenant-rights organization for general guidance.
