Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-59
Every owner or operator of any dwelling who rents, leases or lets for human habitation any dwelling unit contained within such dwelling on terms, either expressed or implied, to supply or furnish heat to the occupants thereof, shall maintain therein a minimum temperature of 70 degrees Fahrenheit, between the hours of 6:30 in the morning and 10:00 in the evening of each day whenever the outdoor temperature shall fall below 50 degrees Fahrenheit during the aforesaid hours and not less than 60 degrees Fahrenheit, between the hours of 10:00 p.m. and 6:30 a.m. Whenever a dwelling is heated by means of a furnace, boiler or other heating apparatus under the control of the owner or operator of the dwelling, such owner or operator, in the absence of a written contract or agreement to the contrary, shall be deemed to have contracted, undertaken or bound himself to furnish heat in accordance with the provisions of this section to every dwelling unit which contains radiators, furnace heat duct outlets or other heating apparatus outlets, and to every communal bathroom and communal toilet room located within such dwelling.

Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-59, any landlord who agrees—explicitly or by implication—to provide heat must keep rental units at a minimum of 70°F between 6:30 a.m. and 10:00 p.m. whenever outdoor temperatures drop below 50°F, and at least 60°F overnight from 10:00 p.m. to 6:30 a.m. When a furnace, boiler, or similar heating system is under the owner's or operator's control, the law presumes a heating obligation exists for every unit with radiators or heat duct outlets, as well as shared bathrooms and toilet rooms, unless a written contract says otherwise. This provision establishes both the temperature thresholds and the circumstances under which a heating duty is legally assumed.

For Property Managers

Owners and operators covered by Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-59 generally ensure that centrally controlled heating systems are maintained and monitored so that daytime temperatures meet the 70°F threshold and overnight temperatures stay at or above 60°F during cold-weather periods. Because the ordinance presumes a heating obligation whenever the owner controls the heating apparatus, compliant operators typically document any written agreements that modify this default arrangement. Keeping maintenance logs, thermostat records, and service contracts can help demonstrate that heating equipment is functioning in accordance with the provision's requirements.

For Tenants

Bellevue, Neb., Code of Ordinances ch. 15, art. III § 15-59 establishes that tenants in units with landlord-controlled heating have a right to minimum indoor temperatures—70°F during daytime hours and 60°F overnight—when outdoor temperatures fall below 50°F. If a unit's temperature falls short of these thresholds, tenants may have grounds to raise a violation of this provision, whether by notifying the landlord in writing, contacting the appropriate local code enforcement or housing authority, or reaching out to a tenant-rights organization for general guidance. Documenting temperature readings with dates and times can be useful when pursuing any of these general enforcement paths.
