Bellevue, Neb., Code of Ordinances ch. 15 (2026) § 15-6
NUISANCES
Operative Text
Nothing in this chapter shall be construed or interpreted to in any way impair or limit the authority of the city to define and declare nuisances or of the Permits and Inspections Department, the chief of police or other city officials to cause the removal or abatement of nuisances by summary proceedings or other appropriate proceedings. (1964 Code, § 12A-12)
Section 15-6 of Bellevue, Nebraska's Code of Ordinances, Chapter 15, Article I, is a savings clause clarifying that nothing in the housing chapter restricts the city's broader authority to identify and address nuisances. The city retains full power to define what constitutes a nuisance and to act swiftly to remove or abate those conditions through summary or other legal proceedings. This provision ensures that the Permits and Inspections Department, the chief of police, and other city officials can still act on nuisance conditions independently of any other rules in the chapter.
Plain English — not legal advice.
Under § 15-6, property owners and managers should be aware that the city of Bellevue retains independent authority to declare conditions on a property a nuisance, separate from any other code enforcement mechanisms. Compliant operators generally maintain properties free of conditions that could be characterized as nuisances, since the Permits and Inspections Department or the chief of police may initiate summary abatement proceedings without being constrained by other provisions of Chapter 15. Keeping records of maintenance activities and promptly addressing reported conditions is a practice commonly associated with operators who avoid nuisance-related enforcement actions.

Section 15-6 preserves the city of Bellevue's authority to act on nuisance conditions through the Permits and Inspections Department, the chief of police, or other city officials, which can be relevant when a property condition affects health or safety. Tenants who believe a property condition rises to the level of a nuisance may have the option of reporting it to the Permits and Inspections Department or contacting local city officials to request an inspection or abatement. Tenant-rights organizations familiar with Bellevue municipal code can help explain what remedies or complaint pathways may be available under this and related provisions.
