Plain English

Under Bellevue, Neb., Code of Ordinances ch. 15, art. IV § 15-92, when a well on a residential property is found to be polluted or otherwise unsafe for drinking or other domestic use, the local Permits and Inspections Department has authority to direct the property owner to either bring the well back into safe condition—through reconstruction and sterilization—or permanently close and fill it. The department sets a reasonable timeframe for compliance. This rule applies whenever the well's water is actually used for domestic purposes on the premises.

For Property Managers

Property owners in Bellevue who have an on-site well used for domestic water supply should be aware that § 15-92 gives the Permits and Inspections Department authority to issue a compliance order if that well is found to be polluted or unsafe. Compliant operators generally maintain records of well condition, respond promptly to any departmental notice, and either restore the well to safe operating standards through reconstruction and sterilization or arrange for proper closure and filling within the timeframe the department specifies. Proactive water quality testing can help owners identify problems before a formal order is issued.

For Tenants

Under § 15-92, tenants living in a dwelling served by an on-site well have an interest in knowing that the Bellevue Permits and Inspections Department can require the property owner to fix or permanently close a well that has become polluted or unsafe for domestic use. If a tenant has concerns about well water quality, general enforcement paths include contacting the Permits and Inspections Department to report the condition or reaching out to a local tenant-rights organization for guidance on available options. Documenting any signs of water contamination—such as unusual odor, color, or taste—can be useful when communicating with the relevant authorities.
