Bellevue, Neb., Code of Ordinances ch. 17 (2026) § 17-2
ADOPTION OF REGULATIONS FOR ENFORCEMENT OF CHAPTER
Operative Text
The board of health is hereby authorized to make and, after public hearing, to adopt such written regulations as may be necessary for the proper enforcement of the provisions of this chapter. Such regulations shall have the same force and effect as the provisions of this chapter, and the penalty for violation of the provisions thereof shall be the same as the penalty for the violation of the provisions of this chapter. (1964 Code, § 13A-9)
Under Bellevue, Neb., Code of Ordinances ch. 17, art. I § 17-2, the local board of health holds authority to create and formally adopt written regulations needed to carry out the chapter's requirements, provided a public hearing is held before adoption. Once adopted, those regulations carry the same legal weight as the chapter's own provisions. Any violation of those board-adopted regulations is subject to the same penalties that apply to violations of the chapter itself.
Plain English — not legal advice.
Bellevue, Neb., Code of Ordinances ch. 17, art. I § 17-2 means that property owners and managers must account not only for the text of Chapter 17 itself, but also for any written regulations the board of health has formally adopted under this authority. Compliant operators generally stay informed of board of health rulemaking activity, including public hearings where new regulations may be introduced. Because board-adopted regulations carry the same enforcement weight as the chapter, the same penalty exposure applies to both.

Bellevue, Neb., Code of Ordinances ch. 17, art. I § 17-2 establishes that the board of health can issue binding written regulations with the same force as the underlying chapter, meaning tenants have protections that may extend beyond the chapter's literal text. If a housing condition appears to violate either the chapter or a board-adopted regulation, tenants can generally raise that violation when engaging with local authorities or seeking information from a tenant-rights organization. Because penalties for violating board regulations mirror those for the chapter itself, the full range of enforcement options available under Chapter 17 may apply.
