Lincoln, Neb., Mun. Code ch. 21.05 § 21.05.040
Section 101.3 Amended; Intent
Operative Text
Section 101.3 of the International Property Maintenance Code is amended to read as follows 101.3 Intent. This code shall be construed to secure its expressed intent, which is to ensure public health, safety, welfare and the protection of neighborhoods from hazardous, blighting and deteriorating influences or conditions that have a negative impact on area property values and discourage property owners from improving their properties, by regulating and controlling the use and occupancy, insofar as they are affected by the continued occupancy and maintenance of structures and premises. Existing structures and premises that do not comply with these provisions shall be altered or repaired to provide a minimum level of health and safety as required herein. Repairs, alterations, additions to and change of occupancy in existing buildings shall comply with the International Residential Code, as amended, and the International Building Code, as adopted by the City of Lincoln. (Ord. 19349 §4; March 1, 2009).
Lincoln Municipal Code § 21.05.040 amends Section 101.3 of the International Property Maintenance Code to establish the overarching purpose of Lincoln's property maintenance regulations: protecting public health, safety, and welfare while preventing neighborhood deterioration and declining property values. The code applies to the ongoing use, occupancy, and maintenance of existing structures and premises. Any structure that falls short of the code's minimum health and safety standards must be brought into compliance through alteration or repair, and any repairs, additions, or changes of occupancy must also conform to the International Residential Code and International Building Code as adopted by Lincoln.
Plain English — not legal advice.
Under Lincoln Municipal Code § 21.05.040, property owners and managers are generally expected to maintain their structures and premises at a minimum level of health and safety at all times, not only at the point of initial construction. Compliant operators routinely inspect their properties for hazardous or deteriorating conditions and address deficiencies before they rise to code violations. When undertaking repairs, alterations, additions, or changes of occupancy, operators ensure that the work meets the standards of the International Residential Code and International Building Code as adopted by the City of Lincoln.

Lincoln Municipal Code § 21.05.040 establishes that tenants have an interest in occupying premises that meet minimum health and safety standards, as the code is expressly intended to protect public welfare and prevent hazardous or deteriorating conditions. Tenants who observe conditions that may fall below these standards can document the issues and report them to the appropriate Lincoln code enforcement authority for inspection. Tenant-rights organizations and legal aid resources can help renters understand how this provision may relate to habitability concerns or other remedies available under local and state law.
