Lincoln, Neb., Mun. Code ch. 21.05 § 21.05.050
Section 102.3 Amended; Application of Other Codes
Operative Text
Section 102.3 of the International Property Maintenance Code is amended to read as follows 102.3 Application of other codes. Repairs, additions or alterations to a structure, or changes of occupancy, shall be done in accordance with the procedures and provisions of the International Residential Code or International Building Code, as adopted by the City. Nothing in this code shall be construed to cancel, modify or set aside any provision of the Lincoln Municipal Code . (Ord. 19349 §5; March 1, 2009).
Lincoln Municipal Code § 21.05.050 amends Section 102.3 of the International Property Maintenance Code to clarify that whenever repairs, additions, alterations, or occupancy changes are made to a structure, those activities must comply with whichever building or residential code the City of Lincoln has adopted. The property maintenance code does not override or nullify any other part of the Lincoln Municipal Code; all applicable local rules remain in effect simultaneously. In other words, this provision ensures that multiple code frameworks work together rather than one displacing another.
Plain English — not legal advice.
Under Lincoln Municipal Code § 21.05.050, property owners and managers who undertake repairs, additions, alterations, or changes of occupancy are generally expected to comply with both the International Residential Code or International Building Code as adopted by Lincoln and any other applicable Lincoln Municipal Code provisions. Compliant operators typically obtain the appropriate permits and follow the procedures required by whichever adopted code governs the specific type of work being performed. Treating these code frameworks as complementary — rather than assuming one supersedes another — reflects the standard approach to compliance under this provision.

Lincoln Municipal Code § 21.05.050 means that when a landlord makes repairs, additions, or alterations to a rental property, or changes how a building is occupied, those actions must meet the standards of Lincoln's adopted building and residential codes, and no part of the Lincoln Municipal Code is waived in the process. Tenants who believe work on their building was done without proper permits or in violation of applicable codes may have grounds to raise those concerns with local code enforcement authorities. Tenant-rights organizations familiar with Lincoln's municipal regulations can help residents understand what options may be available when code compliance is in question.
