Lincoln Municipal Code § 21.05.330 (amending Section 305.1 of the International Property Maintenance Code) establishes shared maintenance responsibilities for the interiors of residential and lodging structures. For Property Managers

Under Lincoln, Neb., Mun. Code § 21.05.330, owners of rooming houses, housekeeping units, hotels, dormitories, and buildings with two or more dwelling units are generally expected to keep all shared or public interior areas and exterior property clean, sanitary, and in good structural repair. Compliant operators typically conduct routine inspections of common areas, address maintenance deficiencies promptly, and ensure that building equipment remains functional and in good repair. Lease agreements often reinforce tenant obligations for the areas they occupy, which can help clarify the division of responsibility contemplated by this provision.

For Tenants

Lincoln, Neb., Mun. Code § 21.05.330 gives occupants a defined responsibility to maintain the portions of a structure they occupy or control in a clean and sanitary condition, while placing the burden for shared and public areas on the owner. If a landlord fails to keep common areas or the structure itself in the required condition, tenants may have grounds to raise that failure as a housing code violation. Tenant-rights organizations in Lincoln or the local code enforcement office can provide information about how complaints under this provision are typically filed and resolved.
