Plain English

Lincoln Municipal Code § 21.05.340 amends Section 305.1.1 of the International Property Maintenance Code to define specific structural conditions that are officially classified as unsafe. These include situations where structural members are overloaded, improperly anchored, or have reached their limit state, as well as deficient stairs, balconies, handrails, and foundation systems. Any condition meeting these definitions must be repaired or replaced in accordance with the International Building Code as adopted by the City, unless an approved alternative method substantiates otherwise or demolition is authorized by the code official.

For Property Managers

Under Lincoln Municipal Code § 21.05.340, compliant property operators routinely inspect structural elements—including load-bearing members, floor and roof anchorage, stairs, balconies, guards, handrails, and foundation systems—to confirm they meet the nominal load requirements described in the provision. When a condition listed in Section 305.1.1 is identified, operators generally arrange for repairs or replacements that conform to the International Building Code as adopted by Lincoln. Where an alternative compliance path is pursued, operators typically obtain approval through a recognized method accepted by the code official before proceeding.

For Tenants

Lincoln Municipal Code § 21.05.340 establishes that certain structural deficiencies—such as compromised stairs, balconies, handrails, or foundation problems—are legally classified as unsafe conditions that a property must address. Tenants who observe conditions that appear to match those listed in Section 305.1.1 may have grounds to report them to Lincoln's code enforcement authority, which has the power to require repairs or replacements. Tenant-rights organizations and legal aid resources can help renters understand what documentation to gather and what general options may be available when structural safety concerns arise.
