Lincoln, Neb., Mun. Code ch. 21.05 § 21.05.345
Section 307 Amended; Handrails and Guardrails
Operative Text
Section 307 of the International Property Maintenance Code is amended to read as follows: SECTION 307 - HANDRAILS AND GUARDRAILS 307.1 General. Every exterior and interior flight of stairs having four or more risers shall have a handrail on one side of the stair and every open portion of a stair, landing, balcony, porch, deck, ramp, or other walking surface which is more than 30 inches above the floor or grade below shall have guards. Handrails shall not be less than 30 inches in height or more than 42 inches in height measured vertically above the nosing of the tread or above the finished floor of the landing or walking surfaces. Guards shall not be less than 30 inches in height above the floor of the landing, balcony, porch, deck, or ramp or other walking surface. Exception: Guards shall not be required where exempted by the adopted building code. (Ord. §3; October 19, 2015).
Lincoln Municipal Code § 21.05.345 amends Section 307 of the International Property Maintenance Code to establish minimum safety requirements for handrails and guardrails in residential and other properties. Any stairway with four or more risers must have a handrail on at least one side, and any open walking surface—such as a balcony, porch, deck, or ramp—that sits more than 30 inches above the ground or floor below must be equipped with a guard. Handrails must fall within a specific height range of 30 to 42 inches, and guards must be at least 30 inches tall, with a limited exception where the adopted building code expressly exempts guards.
Plain English — not legal advice.
Property owners and managers operating in Lincoln should ensure that all stairways with four or more risers are fitted with a compliant handrail on at least one side, as required under § 21.05.345. Elevated walking surfaces—including balconies, porches, decks, and ramps more than 30 inches above the grade or floor below—should be equipped with guards meeting the minimum 30-inch height standard. Routine property inspections that verify handrail heights fall between 30 and 42 inches and that guards are properly installed help demonstrate ongoing compliance with this provision.

Under Lincoln Municipal Code § 21.05.345, tenants living in properties with stairs of four or more risers or elevated walking surfaces have a right to expect properly installed handrails and guards that meet the code's height requirements. If a handrail is missing, improperly sized, or a required guard is absent, this may constitute a property maintenance violation that can be reported to the appropriate local code enforcement authority. Tenants who believe their property does not meet the standards set out in § 21.05.345 may also wish to consult a tenant-rights organization to understand the options available to them.
