Lincoln Municipal Code § 21.09.150 establishes a formal appeal pathway for anyone affected by a decision or action taken by the Planning Director under Chapter 21.09. Appeals are heard by the Housing Advisory and Appeals Board, with the specific procedures and deadlines governed by LMC § 21.05.210. Importantly, enforcement of the Director's decision is automatically paused once a timely appeal is filed and remains paused until the administrative appeal process concludes.

Under § 21.09.150, property owners and managers should be aware that any Planning Director decision affecting their property under Chapter 21.09 can be challenged through the Housing Advisory and Appeals Board. Operators who file a timely appeal in accordance with LMC § 21.05.210 generally benefit from an automatic stay of enforcement during the pendency of that appeal. Familiarity with the appeal timelines set out in § 21.05.210 is important, as missing the deadline can forfeit both the right to appeal and the accompanying enforcement stay.

Section § 21.09.150 of the Lincoln Municipal Code gives affected parties, including tenants, the right to appeal Planning Director decisions under Chapter 21.09 by requesting a hearing before the Housing Advisory and Appeals Board. The rules governing how and when to file that appeal are found in LMC § 21.05.210, and enforcement of any contested decision is put on hold while a properly filed appeal works through the process. Tenants who believe a Director's decision affects their housing situation may wish to review § 21.05.210's deadlines carefully or consult a local tenant-rights organization for general guidance on navigating the appeal process.
