Section 21.56.020 of the Lincoln Municipal Code makes it unlawful to build, maintain, or run a mobile home court or trailer court within Lincoln city limits without either a special permit from the City Council or recognized nonconforming-use status. Courts that were already licensed when the ordinance took effect could continue operating, but only if they met the development and stand standards set out in Chapter 21.56. Mobile homes or trailers that did not comply with foundation system requirements were given up to 24 months to come into compliance; failure to do so could result in the court being declared invalid and ordered vacated within 90 days of written notice from the Building Official.

For Property Managers

Operators of mobile home courts or trailer courts in Lincoln must hold a valid special permit issued by the City Council under § 21.56.020, or maintain properly documented nonconforming-use status, before constructing, maintaining, or operating such a facility. Compliant operators ensure that all individual mobile home and trailer stands meet the foundation system requirements described in Chapter 21.56, since failure to meet those standards can trigger a formal notice of violation from the Building Official. Operators of previously licensed courts generally keep records demonstrating that their facilities satisfy the court development standards required to preserve their operating status under this provision.

For Tenants

Section 21.56.020 establishes that residents of mobile home courts or trailer courts in Lincoln have an interest in knowing whether the court they live in holds a valid special permit or recognized nonconforming-use status, since operating without one is unlawful. If a Building Official issues a written notice of violation, the ordinance provides a 90-day window before a court must be vacated, which may affect residents' housing stability. Tenants who have questions about the permit status of their court or who receive notice of a potential closure may find it helpful to contact the City of Lincoln's Building and Safety Department, review public permit records, or reach out to a local tenant-rights organization for general information about their options under § 21.56.020.
