Positioning of Units
Operative Text
All mobile home units or trailer units shall be positioned on the mobile home space or trailer space in compliance with the requirements of the special permit provisions granted by the City Council or in accordance with the zoning requirements at the time of establishment of the mobile home court or trailer court as follows: (a) In trailer courts constructed prior to November 17, 1953, a distance of at least ten feet shall be maintained between mobile homes or trailers and between mobile homes or trailers and buildings placed side by side longitudinally and not less than six feet shall be maintained end to end between mobile homes or trailers. (b) In trailer courts constructed from November 17, 1953, to November 24, 1969, a distance of at least fifteen feet shall be maintained between mobile homes or trailers and between mobile homes or trailers and buildings placed side by side longitudinally, and not less than ten feet shall be maintained end to end between mobile homes or trailers. (c) In mobile home courts constructed after November 24, 1969, a distance of at least twenty-five feet shall be maintained between mobile homes or trailers, and between mobile homes or trailers and buildings in all horizontal directions, unless specifically adjusted by the City Council upon specific request due to special circumstances as provided in the zoning ordinance . (Ord. 10875 §9; July 30, 1973).
Lincoln Municipal Code § 21.56.090 establishes minimum spacing requirements for mobile home and trailer units within courts, with the applicable distances depending on when the court was originally established. Courts built before November 17, 1953 must maintain at least ten feet side-to-side and six feet end-to-end between units; courts built between 1953 and 1969 require fifteen feet side-to-side and ten feet end-to-end; and courts established after November 24, 1969 require at least twenty-five feet of clearance in all horizontal directions. The City Council may grant adjustments to the post-1969 standard under special circumstances as provided in the zoning ordinance.

Operators of mobile home courts or trailer courts in Lincoln must position each unit in compliance with the spacing minimums set out in § 21.56.090, which vary based on the court's original construction date. Compliant operators identify which historical tier applies to their property, maintain the corresponding clearances between units and any buildings, and document any City Council-approved special permit adjustments if they rely on a variance from the post-1969 twenty-five-foot standard. Keeping accurate records of the court's establishment date and any special permit provisions helps demonstrate ongoing compliance with this section.

Residents of mobile home courts or trailer courts in Lincoln are protected by the spacing standards in § 21.56.090, which are intended to ensure safe distances between units. If a tenant believes units in their court are positioned closer together than the applicable minimums allow, they may raise this concern with the City of Lincoln's relevant code enforcement or zoning authority, or consult a tenant-rights organization familiar with local municipal code. Understanding which construction-date tier applies to a particular court is a useful starting point when evaluating whether the spacing in place meets the requirements of this provision.
